Even though the guidelines are not yet final, they already indicate the Commission’s interpretation of Article 50 and the categories of cases it is basing its approach on.
The transparency obligations under Article 50 of the AI Act are set to take effect on August 2, 2026.

Structurally, the requirements primarily concern four areas:

AI systems that interact directly with humans,

synthetic content in the form of images, audio, video, or text,

emotion recognition and biometric categorization, as well as

deepfakes and certain texts intended to inform the public.

This is relevant for companies because many digital products, communication solutions, and content processes may have at least some overlap with these categories.

The guidelines are particularly practical where they define typical cases: for example, with chatbots, voice assistants, or other systems involving direct user interaction; with AI-assisted processing of images, audio, video, or text; and regarding the question of when realistic-looking AI content can be classified as deepfakes. Especially for marketing, customer communication, and content creation, the examples provide important guidance on when labeling requirements may apply and how exceptions should be understood.

In addition, the guidelines also clarify that multiple transparency obligations may apply simultaneously, depending on the role of a company in the specific context.

The new transparency obligations apply alongside potential additional legal requirements: Data protection requirements, particularly under the GDPR, as well as other issues such as intellectual property rights, personality rights, or other regulatory requirements must also be considered separately.

Webinar Note:
In our webinar on June 9th, 2026 at 4.00pm we provide a practical overview of the guidelines, highlight the most relevant case scenarios for companies, and explain the intersections between the AI Act, product design, and compliance.

Webinar registration

The EU Commission has published a draft of guidelines for Article 50 of the AI Act, which explains the transparency requirements for

[1
