With the AI Act, the European Union is introducing transparency requirements for certain AI-generated content. These transparency requirements must be implemented from <\/em>2<\/em> August 2026.<\/strong> This raises a number of questions for businesses, including: Will newsletters or blog posts created with the assistance of AI need to be labelled in future?<\/p>\n\n\n\n

The answer is: it depends.<\/p>\n\n\n\n

When does the labelling requirement apply?<\/strong><\/p>\n\n\n\n

The transparency requirement applies to deployers of AI systems when they publish texts that have been generated or edited, in whole or in part, by AI and which serve to inform the public about matters of public interest.<\/p>\n\n\n\n

Whether a company newsletter or blog post falls under this requirement must therefore be assessed on the basis of several criteria.<\/p>\n\n\n\n

Firstly, the text<\/strong> must be published<\/strong>. This includes content aimed at an unspecified or broad readership \u2013 regardless of whether access is free or subject to a fee. Corporate blogs or newsletters with a large readership may fulfil this requirement. By contrast, content in closed or purely private groups is generally not covered.<\/p>\n\n\n\n

Furthermore, the text must serve to inform the public<\/strong>. This refers to content that conveys knowledge, opinions or facts. Purely promotional content or product offers will generally not fall under this transparency requirement.<\/p>\n\n\n\n

Another key factor is whether the post relates to matters of public interest<\/strong>. These include, in particular, topics from the fields of business, politics, public administration, health, security, science or culture. If, for example, a business reports on regulatory developments or new legal requirements, such a newsletter may well contain information of public interest.<\/p>\n\n\n\n

How should the disclosure be made?<\/strong><\/p>\n\n\n\n

If the transparency requirement is applicable, disclosure must take place at the time of the first interaction<\/strong>. Readers should be able to recognise immediately that a text has been generated, in whole or in part, using AI.<\/p>\n\n\n\n

The labelling must be clear, unambiguous and easily noticeable<\/strong>, and must comply with the applicable accessibility requirements. Information hidden in the legal notice or in the terms of use is generally unlikely to be sufficient for this purpose.<\/p>\n\n\n\n

Are there any exemptions?<\/strong><\/p>\n\n\n\n

Yes. The AI Act provides one important exemption.<\/p>\n\n\n\n

Labelling is generally not required<\/strong> if the AI-generated or AI-edited text has been subject to genuine human review or editorial oversight,<\/strong> and a natural person or legal entity assumes editorial responsibility<\/strong> for its publication.<\/p>\n\n\n\n

The regulation sets high standards for human oversight. A merely superficial review or a simple spell-check and grammar check is not sufficient. Rather, a substantive review is required, in which the responsible person performs an assessment of the content, revises it where necessary, and assumes responsibility for the published content.<\/p>\n\n\n\n

What does this mean for businesses?<\/strong><\/p>\n\n\n\n

Many businesses now use AI to produce newsletters, specialist articles or blog posts. Those who use AI merely as a writing aid and subsequently carry out a careful editorial review and approval of the content will often be able to invoke an exemption.<\/p>\n\n\n\n

Nevertheless, it is advisable to document internal processes. Businesses should keep a clear record of when AI was used, who carried out the content review and who bears editorial responsibility.<\/p>\n","protected":false},"excerpt":{"rendered":"
