| On November 15, 2023, the European Data Protection Board (EDPB) adopted guidelines on the technical scope of Article 5(3) of the ePrivacy Directive (the so-called Cookie Directive). This was associated with a public consultation process that ran until January 18, 2024, and in which German industry associations such as the BVDW and Bitkom participated. Criticism from the business sector focused particularly on the extensive interpretation of Article 5(3) of the Cookie Directive. A complete overview of the received comments can be found here.
