Adjustments to information obligations required


The German “Digitale Dienste Gesetz” (DDG) came into force on May 14, 2024. It regulates the obligation to provide a legal notice, responsibilities, fines, the obligation to make commercial services recognizable and should not be confused with the Digital Services Act (DSA), which deals with online integrity. On the one hand, the DDG renames laws. For example, the Telemedia Act (TMG) becomes the DDG; the Telecommunications Telemedia Data Protection Act (TTDSG) becomes the Telecommunications Digital Services Act (TDDDG). The paragraphs of Section 5 TMG (obligation to provide a legal notice), Section 3 TTDSG (telecommunications secrecy) and Section 25 TTDSG (cookie consent), which are mainly relevant in the online environment, should be renamed Section 5 DDG, Section 3 TDDDG and Section 25 TDDDG, respectively, with corresponding obligation to cite them.
